On November 14, 2024 the Constitutional Court of the Russian Federation has published Resolution No. 52-P on the case of verifying the constitutionality of paragraph 1 of Article 308.3 of the Civil Code of the Russian Federation, part 3 of Article 206 of the Civil Procedural Code of the Russian Federation and Article 419 of the Labor Code of the Russian Federation in connection with the complaint of Mr. S.S. Shapka.

The List of Advertising Expenses That Cannot Be Deducted for Profits Tax Purposes Has Been Updated

On 29 November 2024, Federal Law No. 416-FZ “On Amendments to Part Two of the Tax Code of the Russian Federation and Certain Legislative Acts of the Russian Federation” (hereinafter referred to as the “Law”) was officially published. The Law amends the Article 270 of the Tax Code of the Russian Federation (hereinafter referred to as the “Tax Code”) which determines the list of expenses that cannot be deducted for profits tax purposes.

On November 27, 2024 the Federation Council approved laws amending the Criminal Code of the Russian Federation (hereinafter referred as the “Criminal Code”) and the Code of Administrative Offences of Russian Federation (hereinafter referred as the “Administrative Offences Code”) to and toughening liability for violations of law in the area of personal data (in accordance with the previously introduced Draft Laws: No. 502104-8 “On Amending the Code of Administrative Offences of the Russian Federation” and No. 502113-8 “On Amending the Criminal Code of the Russian Federation”).

Start Of the Experiment on Monitoring of Manufacturers of Dietary Supplements, Clothing and Footwear

On November 22, 2024, the Government of the Russian Federation (the “Government”) approved Resolution No. 1607 dated November 22, 2024 (the “Resolution”) on the experiment in the territory of the Russian Federation to conduct monitoring of Russian manufacturers of goods which are subject to mandatory marking with means of identification using the state information monitoring system for the circulation of goods subject to mandatory marking with means of identification (the “Experiment”).

Mentoring Will Be Paid as from 1 March 2025

On 9 November 2024 the Federal Law No. 381-FZ “On Amendments to the Labor Code of the Russian Federation” was published. Amendments introduce Article 3518 to the chapter regulating the work of other categories of employees (hereinafter referred to as the “Article”). The Article regulates the mentoring in labor relations. The regulation will enter into force on 1 March 2025.

Application of Limitation Period to Anti-corruption Claims of Prosecutor’s Office

On 31 October 2024 the Constitutional Court published Resolution No. 49-P on the case of checking the constitutionality of Articles 195, 196, paragraph 1 of Article 197, paragraph 1 and paragraph two of paragraph 2 of Article 200, paragraph two of Article 208 of the Civil Code of the Russian Federation (hereinafter - the “Resolution”), in which it considered the application of limitation period to claims for seizure of property obtained through corrupt activities in favor of the state.
