Legal Digest: Patent Disputes in Life Sciences (January 2023)

The new General license No 6C published by OFAC on January 1, 2023, establishes exceptions from US sanctions related to the spheres of agricultural commodities, medicine, medical devices, replacement parts and components for medical devices, or software updates for medical devices.
Based on the Government Decree No. 593 of 5 April 2022 Multiagency Commission on the detection of medicines shortage or a risk of shortage included 88 INN in different forms and dosages (97 names in total) in the relevant list.
From September 01, 2023, changes in the procedure for conducting medical examinations before, during and after a workday (shift) come into force. Namely, starting from September, employers will be granted the right to conduct such examinations remotely – using medical devices that provide automated remote transmission of information about the health status of employees and remote monitoring of their health status.
On 5 December 2022, Federal Law “On Amendments to Article 56 of the Federal Law “On Circulation of Medicines” Regulating the Activities of production Pharmacies in Russia was officially published.

In October 2022, the European Commission approved the eighth package of sanctions against Russia. A few weeks later, on October 24, the European Commission published answers to frequently asked questions including explanations as to what kind of legal services fall under the ban and whether the extension of sanctions to this sphere does not entail restrictions on the right to protection.

The new Federal law will enter into force on 18 October 2022. The amendments provide for the possibility to challenge extension of a patent related to a medicine, pesticide, or agrochemical (granting SPCs) by filing an opposition with Rospatent according to procedure set out in Article 1398 (2) of the Russian Civil Code if conditions for such patent extension, stipulated in Article 1363 (2) of the Russian Civil Code, have been violated.
On July 29, the Government introduced Bill No. 173061-8 "On Amendments to the Federal Law "On the Circulation of Medicines" in order to conduct an experiment on the retail sale of medicines for medical use, prescription medicines, remotely
