The Law on Fines for Unreasonable Collection of Personal Data Was Approved

On 25 May 2022 Federation Council approved the Federal Law "On amendments to Article 14.8 of the Administrative Offences Code of the Russian Federation".

Now Article 14.8 of the Administrative Offences Code provides liability for refusal to conclude a contract with the consumer due to the refusal to provide personal data which are not mandatory under the federal laws and other regulations adopted in accordance with them or are not directly related to the perfomance of the contract.

The amendments were intended by implementing the changes to Article 16 of the Consumer Rights Protection Law, about which we mentioned earlier, and provide the following changes on personal data:

  • The seller has no right to refuse to enter into a contract due to the consumer's refusal to provide personal data, except in cases where the obligation to provide personal data is related to the performance of the contract;
  • The consumer has the right to submit requests for information about the reasons for the refusal to conclude the contract.

Please be reminded that all changes will enter into force on 1 September 2022.
