The Ministry of Economic Development prepared a draft law on the Register of the pharmaceutically active ingredients

During the meeting with foreign companies on 16 September 2021, the Ministry of Economic Development announced that it prepared a draft law on the Register of the pharmaceutically active ingredients protected by patents (link). 

The Register shall contain information on patents protecting the exact active ingredients as well as information on patent holders. All patents shall be recorded by INN.

The Register will be kept by Rospatent and will be publicly available so that any person has an opportunity to get information on patents for an active ingredient.

The draft law shall be sent for interagency review soon. Ministry of Health, Ministry of Industry and Trade, and Federal Antimonopoly Agency have already supported the draft law. It is also planned to introduce the Register at the EAEU level. 

The Register introduction should primarily benefit right holders, who will be able to use information from the Register to protect their rights in courts or governmental bodies, preventing generics from being launched into the market before the patent expires.

Meanwhile, it is still unsettled whether patents protecting pharmaceutical compositions or combinations are to be included in the Register or whether generics may be registered before the patent expires.
