Lidings’ attorneys have defended interests of Taiwanese company ASUSTeK in the Federal Antimonopoly Service (FAS)


Several leading manufacturers of notebooks sold throughout Russia (Асеr, ASUSTeK Computer Inc., Dell, Hewlett-Packard, Samsung Electronics, and Toshiba) were faced with an investigation by the Russian Federal Antimonopoly Service (FAS) in June 2009.

The investigation was initiated on the basis of the coordinated actions of these companies, which were suspected of pre-installing software from the same manufacturer on the PCs they produced. The result of this alleged activity was that consumers were unable to choose and purchase their preferred model without pre-installed software - in this case, Microsoft Windows.

Acting for their client ASUSTeK Computer Inc., together with attorneys from Akin Gump Strauss Hauer & Feld, Baker & McKenzie, Clifford Chance, Dewey & LeBoeuf, and Orrick, Herrington & Sutcliffe LLP, all of whom were acting on behalf of the other PC producers, attorneys from Lidings’ corporate and litigation practice groups proved that antimonopoly legislation had not been breached. The investigation was halted, and a resolution found that was acceptable to manufacturers, consumers, and the FAS.
