Lidings Becomes the First Law Firm in Russia to Ensure Establishment of a New Type of NCO in the Country


Lidings announces the completion of a large-scale project on comprehensive legal support of establishing a new type of non-commercial organizations (NCO) in Russia created to ensure substantive implementation of waste recycling standards by its members – tyre producing companies and consumer electronics and computer equipment manufacturers and traders. Both NCOs were established upon request of the firm’s clients – the Tyre Manufacturers Association (TMA) and the Association of Trading Companies and Manufacturers of Electrical Household and Computer Equipment (RATEK).

As TMA’s and RATEK’s legal advisor, Lidings’ corporate and M&A practice group headed by firm’s partner Sergey Patrakeev ensured the establishment of the two unions created specifically in order for its members (member-companies of TMA and RATEK) to comply with waste recycling standards according to the Federal Law 89-FZ from 24.06.1998 «On production and consumption wastes», taking into account the changes introduced into it by 458-FZ with regard to the requirements for the implementation of waste recycling standards and environmental fee payments.

“In accordance with the new mandatory waste recycling standards introduced by the Government of the Russian Federation two of our clients – specialized organizations which member-companies  are large manufacturers and importers of an automobile tyres and electronics and household appliances operating in Russian faced an issue of establishing independent organizations to ensure compliance with prescribed standards. However, due to the fact that establishment of such NCO’s have become obligatory just recently, relevant expertise in legal support of its establishment and further operational activities virtually does not exist”, - comments managing the project Lidings’ Partner Sergey Patrakeev, Head of the Corporate and M&A practice of the firm.
