Novelties in migration legislation

Several important changes in migration area came into effect:

1.    Special migration registration procedure for foreign nationals during the period of the FIFA championship events held in Russia

Starting from 1 June 2017 the Decree of the President of the Russian Federation No. 202 dated 09 May 2017 “On peculiarities of applying enhanced security measures during carrying out FIFA World Cup 2018 and FIFA Confederations Cup 2017 in the Russian Federation” (hereinafter – “Decree No.202”) entered into force. The Decree No.202 establishes special rules regarding migration registration procedure to be applied during FIFA World Cup 2018 and FIFA Confederations Cup 2017.

Namely, Art. 4 of Decree No.202 stipulates the following:

  • during the period from 1 June 2017 till 12 July 2017 when arriving to the territory of Moscow, Saint-Petersburg, Kazan, Sochi; and
  • during the period from 25 May 2018 till 25 July 2018 when arriving to the territory of Moscow, Saint-Petersburg, Kazan, Sochi, Volgograd, Yekaterinburg, Kaliningrad, Nizhny Novgorod, Rostov-on-Don, Samara, Saransk

migration registration of foreign nationals arriving for the purposes of temporary stay (temporary or permanent residence) is carried out within one day as of the foreign national’s arrival to place of temporary stay  or place of residence. The regular timeline for migration registration is seven days.

Additionally, Decree No.202 imposes some limitations to the migration registration methods. For the purposes of migration registration host party or foreign national shall submit a notification of arrival directly to the relevant local authority of the Ministry of Interior. Submission by post or through multifunctional center of state services under Decree No.202 is not provided.

Enhanced security measures regarding migration registration do not apply to foreign nationals, who are participants of FIFA World Cup and/or FIFA Confederations Cup, representatives of FIFA, FIFA subsidiaries, confederations and national football associations put on FIFA lists.

2.    Prohibition on employment of Turkish nationals, as well as certain other sanctions against the Turkish Republic are lifted1

On 31 May 2017 the Decree of the President of the Russian Federation No. 244 dated 31 May 2017 “On the abolition of certain special economic measures against the Turkish Republic” (hereinafter – “Decree No.244”) entered into effect.

More specifically, Decree No.244 envisages the following important changes in the relations with the Republic of Turkey:

  • Prohibition on employment of Turkish nationals by Russian companies is lifted

Now Turkish nationals can be employed on the general grounds, which will allow Russian employers and commissioners of works, services to engage larger number of employees.

  • Prohibition and limitations on Turkish companies  related to performing certain types of activities (rendering services) within Russia is lifted

Abolition of the aforementioned prohibitions will encourage drift of labour and capital renewal from Turkey to Russia.

  • List of categories of Turkish nationals granted with a visa-free entrance to Russia is enlarged

Receipt of a visa for entry into the territory of Russia starting from 31 May 31 2017 is not needed for diplomats and members of their families, Turkey nationals, who visit Russia for a short-term business trip, as well as pilots and aircrew members.
