Lidings Legal Brunch: Discussing Recent Changes in Russian Law

Lidings has conducted an annual fall event for its clients and partners - the legal brunch, which took place in the Moscow’s Intercontinental hotel on the 12th of November.

Lidings’ client-oriented events, traditionally organized in the form of an open dialogue between the firm’s experts and invited guests - representatives of the leading Russian and international companies, allow all participants to share experience, discuss the latest legislative initiatives and relevant regulatory issues in a relaxed friendly atmosphere.

During these meetings, the firm’s experts analyze a number of the most recent major innovations in the Russian law from the standpoint of their practical implementation and offer participants their recommendations. Thus, the following important legislative changes taken place in 2015 were featured as the main topics of the brunch on 12th of November:

  • Getting Ready to Play by the New Rules: Fourth Set of Antitrust Measures
  • Bankruptcy: Consequences of the Reform

The outlined topics were covered by Lidings’ corporate and M&A and dispute resolution practice lawyers.

Corporate and M&A practice counsel Vadim Konyushkevich together with the firm’s dispute resolution practice counsel Petr Nikitenko spoke on what has changed with the adoption of amendments to the Civil Code and the clarifications from Supreme court. Among other issues they touched upon those concerning the new obligations’ law, consequences of breach of obligations, issues relevant to fictitious and feigned transactions, as well as concentrated on some aspects related to the application of the Civil Code of the RF provisions regarding statute of limitations.

Partner and head of the firm corporate and M&A practice Sergey Patrakeev has advised the respectful audience on how to play the game by the new rules, stemming from a massive set of amendments to the antimonopoly legislation of the Russian Federation which is also unofficially referred to as the «fourth set of antitrust measures». In his speech he elaborated on the changes in the federal law on protection of competition, including forms of unfair competition, thoroughly analyzed the procedure of consideration of cases on violation of antimonopoly legislation, and touched upon the principal changes in the administrative code as well.

Lidings’ dispute resolution practice Senior associate Alexander Popelyuk spoke on the changes in the bankruptcy legislation that came into force this year. He recounted the change in the position of secured creditors, extension of insolvency practitioner’s rights, as well as addressed the audience to the changes having occurred in respect of rules for debtor’s filing voluntary petition of its own bankruptcy.
