Highlights of the ABA’s Seventh Annual Dispute Resolution Conference 2015

In mid-September Moscow once again became the center of attraction for the leading international arbitration and dispute resolution experts from around the world that gathered together to take part in the international dispute resolution conference hosted by American Bar Association (ABA).

Conference took place on September 18th in one of the most luxurious Moscow hotels located in a very heart of the city - Ritz-Carlton followed by a reception at the bar located on the hotel’s roof.

Lidings traditionally supported the event in terms of  strategic and organizational planning, taking an active part in development of the program and general concept of the conference that over the seven years of existence proved to be a unique platform for communication between lawyers from Europe, Asia, America, Africa, and CIS countries.

The list of key participants as usual included Russian and American judicial authorities, arbitrators of international arbitration institutions, legal experts representing prominent Russian and international law firms, and in-house corporate counsels.

Lidings partner Andrey Zelenin heading dispute resolution practice of the firm together with UK experts barrister Rupert D'Cruz of Littleton Chambers and Katerina Haslam-Jones from Padva Haslam-Jones & Partners co-moderated one of the interactive roundtables dedicated to recent developments that are said to challenge the primacy of English law as a choice of governing law in Russian related transactions.

During this round table Mr. Zelenin jointly with his foreign colleagues, prominent international arbitration experts in a live open-format discussion brought up and highlighted a number of relevant issues:

  • How real is the challenge of the primacy of English law as a choice of governing law in Russian related transactions?
  • To the extent that it exists, is it caused just by the sanctions-related issue and of temporary effect or are longer-term factors (such as de-offshorization and changes to the Russian Civil Code) now playing a significant role?
  • In what contracts are changes in governing law occurring – or not occurring?
  • What types of companies are implementing (or considering) such changes and which ones are likely to continue with ‘the established approach’?
  • In so far as alternatives to English law are being considered, what are the practical alternatives and why?
